Landlord Tenant Issues and Concerns When Renting with a Service Animal

Posted by Ask Emily on April 15, 2018 at 1:05 PM
Landlords are everywhere and some are more knowledgeable about laws and accommodations, when it comes to people with disabilities than others. Some landlords claim ignorance when it comes to accommodations and what is legal and what is not. Some people may or may not know for example, that a SERVICE ANIMAL is not a PET and therefore the rules are a little bit different when it comes to renting. If you have legal documentation that you in fact require a SERVICE ANIMAL, the landlord LEGALLY can't charge you a PET DEPOSIT or PET RENT on a monthly basis. The same however, CAN'T be said for EMOTIONAL SUPPORT ANIMALS. An EMOTIONAL SUPPOT ANIMAL is NOT the same as a SERVICE ANIMAL, just like a SERVICE ANIMAL, is not the same as a PET. Below is a really good website with resources to review: https://www.animallaw.info/topic/table-state-assistance-animal-laws
